Please read these Terms of Service ("Terms") carefully before using SilentCue ("Service"), operated by SilentCue ("we", "us", or "our"). By accessing or using the Service, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account or using SilentCue, you confirm that you are at least 16 years old and agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.

SilentCue is an AI-powered interview assistant that provides real-time answer suggestions during job interviews based on your uploaded CV and job description. The Service is intended as a productivity and preparation tool.

To request a refund, contact us at support@silentcue.app within 7 days of the charge. Refunds are only issued if you have used less than 10% of the included minutes and sessions. Requests that exceed this usage threshold are not eligible for a refund.

6. Intellectual Property

All content, branding, software, and technology within SilentCue is owned by us or our licensors. You retain ownership of the data you upload (CV, job descriptions). By uploading data, you grant us a limited license to process it solely to provide the Service.

The AI-generated answers provided by SilentCue are suggestions only. We make no claim of ownership over generated content and grant you full rights to use it.

7. Disclaimers and Limitation of Liability

7.1 No Guarantee of Success

SilentCue is a preparatory aid and productivity tool only. We do not guarantee job offers, interview success, or any specific career outcome resulting from use of the Service. Your final performance in any interview or hiring process remains your sole responsibility.

7.2 Third-Party Dependency

The Service depends on third-party providers including Deepgram (speech-to-text), Anthropic and OpenAI (large language models), and Stripe (payments). We are not liable for any malfunction, degraded performance, high latency, data loss, or service interruption caused by these third-party providers. Their availability and behaviour are outside our control.

7.3 "As Is" and "As Available"

The Service is provided on an "as is" and "as available" basis, without any express or implied warranties of any kind, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components.

7.4 AI Accuracy

AI-generated content produced by the Service may contain inaccuracies, errors, or "hallucinations" — outputs that appear plausible but are factually incorrect. You acknowledge that you must exercise your own independent judgement before relying on any AI-generated suggestion during a live session or otherwise. We are not liable for any harm resulting from reliance on AI-generated content.

7.5 Overlay Visibility — Scope of "Undetectable" Claims

The floating overlay used by SilentCue is built on the Document Picture-in-Picture (dPiP) browser API and is rendered as a native OS-level window. It is not captured by Zoom, Teams, Google Meet, or similar platforms when those platforms are sharing a specific browser tab or application window. It does not appear in your webcam feed under any circumstances.

However, the overlay may be visible in the following situations:

  • You share your entire display (full-screen monitor capture) rather than a specific tab or window — in this case, position the overlay on a secondary monitor not being shared.
  • The interviewer's platform uses dedicated proctoring software (e.g. HireVue, Proctorio, Codility) that captures the full display at OS level.

It is your responsibility to understand the screen-sharing and monitoring requirements of the interview process you participate in. SilentCue makes no guarantee that the overlay will be invisible in all circumstances, and we are not liable for any consequences arising from its detection.

7.6 Limitation of Liability

To the maximum extent permitted by applicable law, SilentCue and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Service, including but not limited to lost employment opportunities, lost income, or reputational harm. Our total aggregate liability to you shall not exceed the amount you paid us in the 12 months preceding the claim.

8. Termination

We reserve the right to suspend or terminate your account at any time for violation of these Terms, with or without notice. You may delete your account at any time by contacting support. Upon termination, your right to use the Service ceases immediately.

9. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by updating the date at the top of this page. Continued use of the Service after changes constitutes your acceptance of the revised Terms.

10. Governing Law

These Terms are governed by and construed in accordance with applicable law. Any disputes shall be resolved through good-faith negotiation, and if unresolved, through binding arbitration or the courts of the jurisdiction in which we operate.
